1. Introduction
- The Terms of Service prescribe the general terms of use of the Website, which enables browsing and reading the content of pages within the Website, using the Contact Form and the Newsletter service.
- The Terms of Service are provided to each User on the Website free of charge prior to conclusion of the Contract, as well as — upon the User's request — in a manner enabling the User to obtain, copy and record their content by means of a teleinformatic system used by the User.
- The User may only use the Services upon becoming acquainted with and accepting the Terms of Service and the Privacy Policy. If the User does not accept them, the User may not use the Services. For a User who is not a consumer, it is deemed that by starting to use the Services the User has accepted the Terms of Service and the Privacy Policy without reservations.
- The Terms of Service are supplemented by the Privacy Policy.
2. General terms and conditions of service provision
- To use the Services and the functionalities of the Website, the User must meet the following minimum technical requirements: (a) a device with Internet access; (b) the latest version of one of the following browsers installed: Firefox, Opera, Edge, Chrome, Safari; and additionally, for the Newsletter, (c) an active e-mail account.
- Using the Website is free of charge, except for any data-transmission costs resulting from agreements concluded between the User and telecommunication operators.
- It is not permitted to provide unlawful content as part of the Services or the Website, or to act contrary to the Terms of Service, applicable legal provisions, good practices and rules of social co-existence.
- The Website and its elements, including design and content, are protected by copyright or other intellectual-property rights. They may not be reproduced, distributed or published, in whole or in part, by the User without Ulam Labs' consent.
- Ulam Labs does not provide Services to consumers.
3. Newsletter
- Ulam Labs provides the Newsletter subscription service to Users who give their voluntary consent through the Website functionalities.
- To activate the Newsletter subscription, the User needs a device with an Internet connection, an installed and updated Internet browser and an active e-mail address.
- To subscribe, the User orders the Newsletter via an interactive form on the Website, providing their e-mail address, and activates the service through a link included in the e-mail sent to that address.
- Upon activation, an agreement for provision of the Newsletter service is concluded between Ulam Labs and the User for an unlimited period of time.
- The User may terminate the Newsletter agreement at any time with immediate effect by deactivating the subscription, using the relevant link provided in the footer of each Newsletter message.
4. Contact Form
- Through the Website, Ulam Labs provides the Contact Form Service, giving the User free contact with Ulam Labs to obtain information about the offer, availability and scope of services provided by Ulam Labs as part of its business.
- Ulam Labs also provides the Contact Form Service in the form of an option to book a video conference. To do so, the User should follow the instructions indicated on the Website.
5. Withdrawal
- If the User is also a consumer, they may withdraw from the Contract without giving a reason by filing a declaration of withdrawal with Ulam Labs (via e-mail) to privacy@ulam.io. The term for withdrawing is 14 days from conclusion of the Contract; sending the declaration before that term lapses is sufficient to comply with it.
- If the User is a consumer, the right of withdrawal does not apply in the case prescribed in Article 38.13 of the Act on Consumer Rights of 30 May 2014 — i.e. an agreement for digital content not recorded on a physical carrier, where performance has commenced upon the User's express consent before the withdrawal term lapses and after being notified of the loss of the withdrawal right. Consequently, once provision of the Services has commenced, the User is not entitled to withdraw.
- The right of withdrawal also does not apply in the case prescribed in Article 38.1 of the Act on Consumer Rights of 30 May 2014 — i.e. contracts for services fully performed upon the express consent of a consumer informed beforehand that, upon completion, they will lose the right to withdraw.
6. Complaints
- The User may file a complaint concerning operation of the Website and the Services. A complaint should include at least the details enabling identification of the User and state reasonable reservations and comments. It should be sent via e-mail to privacy@ulam.io or to Ulam Labs' correspondence address. If a complaint needs to be completed, Ulam Labs will request the User to do so. Ulam Labs will respond within 14 days of receipt, to the address from which the complaint was sent or the address stated in the complaint.
7. Specific rules
- For Users who are not consumers, in particular those using the Services as part of their business or professional activity, the following specific provisions apply: (1) Ulam Labs is not liable for damage caused to Users by unintentional fault, and its liability is limited to actual losses incurred by the User; (2) any disputes arising out of the Contract or the User's use of the Website or Services are settled by the common court having jurisdiction over Ulam Labs' registered office.
8. Amendment to the Terms of Service
- Ulam Labs may amend these Terms of Service for material reasons, whether legal (a change in generally applicable legal provisions related to Ulam Labs' activity, or a change in its business form) or technical. The reason for any amendment is provided each time in the manner described below.
- Users are notified of any amendment by an e-mail sent 7 days before the new wording takes effect. Within this time, a User who is a consumer must accept the amended Terms of Service again or refuse to accept them. If a User who is not a consumer does not terminate the provision of Services within that term, the User is deemed to have accepted the amended Terms of Service without reservations.
- Any orders filed prior to the effective date of an amendment are processed in accordance with the Terms of Service applicable at that date. Amendments may not infringe Users' acquired rights.
9. Final provisions
- The governing law for liabilities resulting from the Terms of Service is Polish law. Any contracts are concluded in the Polish language.
- A consumer may use dispute-resolution methods alternative to court proceedings (ADR), in particular mediation, conciliation or arbitration. A consumer may also use out-of-court means of handling complaints and seeking claims through the EU ODR online platform.
- If the User declines ADR or ODR, any disputes arising out of the Terms of Service or Contracts are settled by the common court with jurisdiction determined under the legal act applicable to the User as a consumer.
- Any disputes arising between Ulam Labs and a User who is not a consumer are referred to the court having local jurisdiction over Ulam Labs' registered office.
